These terms and conditions outline the rules and regulations for the use of Penfyre Designs, LLC's Website, located at penfyredesigns.com.

3. Client Services & Data Processing Agreement

The following terms apply specifically to clients retaining Penfyre Designs, LLC for web design, hosting, or data automation services.

Data Processing and Air-Gapped Security For clients utilizing our Data Automation and Impact Analysis services, Penfyre Designs, LLC agrees to process all supplied data locally on secure, offline ("air-gapped") hardware. Penfyre Designs, LLC strictly prohibits the upload, transfer, or processing of sensitive client data, Personally Identifiable Information (PII), or donor records on public cloud infrastructure or third-party generative AI models.

Chain of Custody and Hard Drive Handoff If a client elects to provide raw data via physical media (e.g., encrypted USB drive), Penfyre Designs, LLC assumes responsibility for the physical media only while it is in our direct physical possession. Penfyre Designs, LLC is not liable for data loss, corruption, or interception that occurs prior to the physical handoff or after the media has been returned to the client. For remote clients utilizing secure end-to-end encrypted file transfers, Penfyre Designs, LLC is not liable for breaches originating from the client's network or the chosen third-party transfer platform.

Data Destruction Protocol To ensure absolute data privacy, Penfyre Designs, LLC adheres to a strict data destruction policy. Within 14 days of final project delivery and client approval, Penfyre Designs, LLC will permanently and securely wipe all raw data, intermediate processing files, and finalized deliverables from our local servers. It is the sole responsibility of the client to safely back up their finalized reports upon receipt.

Web Design Scope and Revisions Custom website packages include up to two (2) rounds of major design revisions. A "major revision" is defined as structural, layout, or significant functional changes. Additional revisions beyond the included rounds, or feature requests outside the original project scope, will be billed at our standard hourly rate, subject to client approval before work commences.

Client Communication and Project Dormancy Timely communication is critical to project success. If a project stalls for more than 30 consecutive days due to client delay (e.g., failure to provide necessary text, branding assets, logins, or feedback), Penfyre Designs, LLC reserves the right to place the project on dormant status. At this time, Penfyre Designs, LLC may issue an invoice for all work completed to date. Reactivating a dormant project may be subject to a reactivation fee and a newly negotiated timeline.

Intellectual Property and Transfer of Ownership Penfyre Designs, LLC retains full legal ownership, copyright, and intellectual property rights to all design work, code, slide decks, and digital assets until the final invoice is paid in full. Upon receipt of final payment, full ownership and usage rights of the completed project are immediately transferred to the client.

Third-Party Hosting Liability For clients purchasing and maintaining their own web hosting, Penfyre Designs, LLC is not responsible for server downtime, data loss, hacking events, or technical failures caused by the third-party hosting provider or a failure of the client to maintain their billing status.

4. User Comments

Parts of this website offer users an opportunity to post and exchange opinions and information in certain areas of the website. Penfyre Designs, LLC does not filter, edit, publish or review Comments before their presence on the website. Comments do not reflect the views and opinions of Penfyre Designs, LLC, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, Penfyre Designs, LLC shall not be liable for the Comments or any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

Penfyre Designs, LLC reserves the right to monitor all Comments and remove any Comments that can be considered inappropriate, offensive, or causes breach of these Terms and Conditions.
